Terms of Service

1. The Service

Cabulary helps you learn vocabulary in a target language through spaced-repetition review, AI-assisted explanations, and optional one-time Word Pack purchases that expand your library capacity. We may add, change, or remove features at any time.

2. Eligibility & Accounts

You must be at least 13 years old to use Cabulary. If you are under 18, you represent that a parent or legal guardian has agreed to these Terms on your behalf. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us at cabulary.contact@gmail.com if you suspect unauthorized access.

3. Word Packs & Payments

Cabulary offers free access with a 200-word library cap. To track more words, you may purchase one-time Word Packs (e.g., Starter Pack, Power Pack, Mega Pack). Word Packs are one-time payments, non-recurring, and the words you add never expire.

All payments are processed by Stripe, Inc. We do not store your payment-card information. Prices are shown in U.S. dollars and may change at any time, but changes do not affect packs already purchased.

4. Refunds

Because Word Packs grant immediate access to additional capacity, purchases are generally final. We will, however, consider refund requests received within 14 days of purchase on a good-faith basis — for example, if you were charged in error or did not receive the capacity you paid for. Email cabulary.contact@gmail.com with your receipt to request a refund. Refunds, when granted, remove the associated word capacity and Plus-tier benefits from your account.

5. Acceptable Use

You agree not to:

• use Cabulary to harass, defraud, or harm others;
• scrape, mirror, or systematically extract content from the service;
• attempt to bypass usage limits, payment, or security controls;
• upload content that infringes others' rights or violates applicable law;
• resell or sublicense Cabulary access without our written permission.

We may suspend or terminate accounts that violate these rules.

6. AI-Generated Content

Cabulary uses third-party AI models (currently OpenAI) to generate example sentences, translations, and tutoring explanations. AI output can be inaccurate, incomplete, or culturally inappropriate. Cabulary does not warrant the correctness of AI-generated content. Use it as a study aid and verify anything important with an authoritative source.

7. Intellectual Property

Cabulary, its brand, software, and curated vocabulary content are owned by Cabbit LLC and protected by U.S. and international intellectual-property laws. We grant you a personal, non-transferable, non-exclusive license to use Cabulary for your own learning. Any content you import (e.g., custom decks) remains yours; you grant us a license to use it solely to operate the service for you.

8. Disclaimers

Cabulary is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that all defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, Cabbit LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Cabulary. Our total liability for any claim relating to the service is limited to the greater of (a) the total amount you paid to Cabulary in the twelve months before the claim arose, or (b) US $50.

10. Termination

You may stop using Cabulary or delete your account at any time. We may suspend or terminate your access if you violate these Terms or for other reasonable business reasons. Sections relating to intellectual property, disclaimers, liability, and governing law survive termination.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or in-app notice at least 7 days before the change takes effect. Continued use of Cabulary after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles. Any dispute must be brought in the state or federal courts located in New York, and you consent to that jurisdiction.
